# SBA 7(a) and 504 Loans: Is a Phase I ESA Required?

October 13, 2026 / By Calibre Commercial Inspections / 4 min read

SBA requires an environmental investigation of all commercial property pledged as collateral on 7(a) and 504 loans. A Phase I ESA is required outright for environmentally sensitive businesses, gas stations and dry cleaners, and whenever an earlier screen finds risk. Reports must be dated within one year of the SBA loan number and come with a reliance letter.

This article reads the SBA’s own text, SOP 50 10 8.1, which took effect October 1, 2026. It is a summary, not legal advice. Your SBA lender decides what it will accept.

## Which SOP version applies to your loan?

SBA’s Information Notice 5000-880695, published August 14, 2026, says SOP 50 10 8.1 applies to applications that are issued an SBA loan number on or after October 1, 2026. It also says lenders must keep using SOP 50 10 8.0 (effective June 1, 2025) for 7(a) and 504 applications submitted through September 30, 2026.

We read the environmental paragraph in the 8.1 text. If your loan is still under 8.0, ask your lender whether any environmental step differs.

## How does the lender pick the level of review?

SOP 50 10 8.1 says the type and depth of review “varies with the risks of Contamination.” The lender starts by finding the NAICS code for the property’s current and known prior uses. It compares that code to the list of environmentally sensitive industries in Appendix 6. The NAICS step does not apply to a unit in a multi-unit building.

Situation

Where the review starts

NAICS code matches an environmentally sensitive industry

A Phase I ESA, regardless of loan amount

Gas station (NAICS code begins with 457)

A Phase I ESA, plus the gas station rules in Appendix 7

On-site dry cleaner, current or past, using chlorinated or petroleum-based solvents

A Phase I followed by a Phase II

Not a sensitive industry, loan up to $250,000

May begin with an Environmental Questionnaire

Not a sensitive industry, loan over $250,000

At minimum an Environmental Questionnaire and a Records Search with Risk Assessment

Records search finds anything other than “low risk”

A Phase I ESA

Transaction Screen says more investigation is warranted

A Phase I ESA

So a Phase I is not required on every loan. For an owner-occupant buying a low-risk office or warehouse, the review can stop at a questionnaire and a records search. A property that was ever a dry cleaner or a gas station cannot take that path.

## What must the report include?

Three rules apply to the paperwork.

**Date.** Environmental investigation reports must be dated within one year of the date of issuance of the SBA loan number.

**Qualified preparer.** Transaction Screens, Phase I ESAs and Phase II ESAs must be performed by an Environmental Professional. SBA defines the term in the SOP.

**Reliance letter.** Each of those reports must be accompanied by the Reliance Letter in Appendix 5. The SOP says the letter is required even if the report is addressed to the SBA lender.

For 7(a) loans, the SOP says failure to follow the environmental paragraph may result in denial of SBA’s guaranty.

If your closing could slip, plan the report date with that one-year limit in mind. Our article on [how long a Phase I ESA stays valid](https://calibre.multisites.ai/cre-inspector-insights/how-long-is-a-phase-i-esa-valid) explains the separate federal 180-day rule for key components.

## What happens if the Phase I finds a problem?

The SOP states that loans may not be approved or disbursed when there is known contamination or ongoing remediation unless the risks have been minimized to SBA’s satisfaction. If the Phase I recommends more investigation, usually a Phase II, and the lender still wants to make the loan, it must follow the consultant’s recommendation or ask SBA for an exception. SBA requires compliance with all of the environmental professional’s recommendations, including “housekeeping measures.”

The SOP lists ways a lender may justify going ahead, such as an indemnification agreement, a no further action letter from a government agency, or an escrow equal to at least 150 percent of the estimated remediation cost. Each has conditions. Your lender and attorney handle that path.

## Is there a special rule for child-occupied facilities?

Yes. A child-occupied facility built before 1978 needs a lead risk assessment and testing for lead in drinking water at taps and fountains children may use. Both must be done within one year of the SBA loan number, for each new loan.

## What does the timeline look like for a purchase?

The date that matters is the date SBA issues the loan number, not the closing date. A report dated more than one year before that date is out of date. Ask your lender when it expects to request the loan number, then work backward. Order the report early enough that the lender can review it and, if needed, order a Phase II before it asks for the loan number.

## What should you ask your lender?

- Which SOP version applies to my loan number?
- What does the NAICS check say about this property and its past uses?
- Who must prepare the report, and will you supply the Reliance Letter form?
- What date will you count the one-year limit to?
- If the first screen is clean, which steps does the SOP still require for this loan?
